Position: Associate, Legal Service and Enforcement

Job Purpose:
– The purpose of this job is to assist the Manager in divisional operations, participate in the investigation of any breaches in compliance, and review drafted operational and administrative policies procedures, rules, and regulations designed by different functional units from a legal perspective, prepare investigation reports, and charges, and follow up the enforcement of disciplinary decisions and produce periodic reports.
SUMMARY OF MAJOR DUTIES AND RESPONSIBILITIES
- Participates in the development and revision of policies, procedures, and manuals of the Division;
- Ensures the organization and safekeeping of files and records of court cases, investigation reports, and other related documents
- Assists the research and analysis regarding laws applicable to the Exchange to identify issues that need an introduction of new rules or amendment of the Rules; drafts Rules of the Exchange, and operational contracts and presents it to appropriate bodies for approval;
- Assist in the development of strategy, arguments, and testimonies in preparation for the presentation of cases before courts of law or other judicial or quasi-judicial institutions;
- Participate in Gathering all necessary evidence to formulate a defense or to initiate legal action to defend the interests of the Exchange;
- Provides legal consultations, comments, advice, and interpretation on issues related to the Rules of the Exchange, Labor Law, and other pertinent laws applicable to the Exchange operation to different Departments/Divisions of the Exchange.;
- Prepares Minutes of Business Conduct Committee meetings and follows up enforcement of BCC’s decision; and prepares letters of disciplinary measures;
- Assists in the preparation of investigation reports regarding rule violations and prepares responses to appeals made by members, clients of intermediary members, or floor representatives.
- Assists the awareness creation programs to members, employees of the Exchange, and other stakeholders concerning the Rules of the Exchange, Labour Law, and other pertinent laws applicable to the Exchange;
- Participates in the revision of internal agreements and procedures, including those between warehouse operators, clearing institutions, members, and clients, to determine legality and compatibility with rules and regulations governing the Exchange;
- Assists in the preparation of responses to requests made by government institutions, business sectors, and other stakeholders as necessary;
- Represents ECX before a court of law, quasi-judicial or administrative organ as necessary;
- Establishes and maintains networks and good relationships with government institutions, business sectors, and other stakeholders as necessary.
- Prepares periodic reports concerning the activities of the Division; and
- Performs other duties assigned by the immediate supervisor
About You
- LLB
- 2 years of relevant work experience in judiciary, prosecution, legal advisory business analysis, exchange operations, surveillance, marketing, or related areas.
