Job description

GIZ, on behalf of the German government, supports the AfCFTA through the GIZ Support project to the AfCFTA (GIZ AfCFTA). GIZ AfCFTA supports the AU Commission (AUC) Department of Economic Development, Trade, Industry, Mining (ETIM) as well as the AfCFTA Secretariat in Accra, Ghana in the AfCFTA negotiations and implementation. All activities of GIZ AfCFTA are closely coordinated across the continental, regional (East African Community EAC, Economic Community of West African States ECOWAS, Southern African Development Community SADC) and country (current focus: Ethiopia, Ghana, Rwanda, Tunisia) level to ensure that all levels are appropriately linked.

The GIZ project has been supporting the AU in carrying out regulatory audits for trade in services as requested by the AU Member States. The audits are inventories of regulatory measures affecting intra-African trade in services. The regulatory audits are a key input into the AfCFTA negotiations as they provide the Member States with crucial information about existing restrictions in their services sectors. This serves as the basis for developing meaningful offers and requests for the TiS negotiations as well as other policies related to TiS.

This work is implemented in close collaboration between GIZ, AU, World Trade Organization (WTO), World Bank Group (WBG) and European Union (EU). The audits follow the same methodology developed by WTO and WBG for the Services Trade Restrictions Index (STRI), which contains data on TiS restrictions in 116 countries across all continents, but which contains only very limited data on Africa. By applying this methodology, the AfCFTA regulatory audits produce data on services which is comparable in quality and scope to data available for other countries.

As of September 2021, the collaboration between GIZ, AU, WTO/WBG and EU brought about regulatory audit reports for almost all AU Member States. However, the existing audits differ in terms of sectoral coverage, the depth of regulatory information covered as well as the quality of documentation for restrictions identified.

This consultancy aims at finalizing the regulatory audit work in five Francophone countries through additional information and quality checks to existing data.

0. Tasks to be performed by the contractor

The contractor is responsible for providing the following service: Conducting regulatory audits in five Francophone countries: Benin, Central African Republic, Chad,… Republic of Congo, Togo.

Qualifications of Expert 1

Education/training (2.2.1): Master’s degree in the field of international trade law, economics, business administration or any other relevant postgraduate degree in relation to the assignment

Language (2.2.2):

§ Fluency in written and spoken English (C2 of Common European Framework or comparable)

§ Fluency in written and spoken French (C2 of Common European Framework or comparable)

  General professional experience (2.2.3):

§ 7 years of professional experience in analysing regulations related to cross-border supply of services sectors

§ 5 years of professional experience related to negotiations of TiS commitments and related TiS policymaking

   Specific professional experience (2.2.4):

§ 5 years cumulative professional experience related to cross-border supply of services in at least 4 of the following sectors: Business, Communication, Financial, Transport, Tourism, Construction, Distribution, Educational, Environmental, Health, Recreational services

§ 7 years of professional experience related to the General Agreement on Trade in Services (GATS) of the WTO or to Trade in Services provisions in bilateral and/or regional trade agreements (active participation in and/or direct technical support to negotiations)

§ 3 previous assignments related to the African Union and/or African Regional Economic Communities

§ 5 previous assignments in advising public institutions in at least 3 of the following countries: Benin, Central African Republic, Chad, Republic of Congo, Togo.

  • Leadership/management experience (2.2.5): 7 years of professional experience as Team Leader and/or manager in Technical Assistance projects
  • Regional experience (2.2.6): 10 years cumulative professional experience in African Francophone countries, particularly Benin, Central African Republic, Chad, Republic of Congo, Togo
  • Development Cooperation (DC) experience (2.2.7): 10 previous assignments in DC projects.
